NOTICE OF PUBLIC HEARING TO CONSIDER

DEVELOPER’S AGREEMENT TERMINATION

9494 SUMMERFIELD, LLC

NOTICE IS HEREBY GIVEN that the Marion County Planning and Zoning Commission, the local planning agency, will hold the first of two public hearings on Monday, January 30, 2023, to consider the termination of the Developer’s Agreement (Termination), pursuant to Sections 163.3220 through 163.3243, inclusive, Florida Statutes, between Lloyd (Loyd) J. Folks and Marion County, Florida (County), dated August 24, 2001, and recorded on June 27, 2003, in O.R Book 3450, Page 484, Public Records of Marion County, Florida. The public hearing will start at 5:30 PM or as soon thereafter as possible and will be held at the McPherson Governmental Campus Auditorium, 601 SE 25th Avenue, Ocala, Florida 34471. All interested parties are invited to attend the public hearing. The date, time, and location of the second public hearing to be held by the Marion County Board of County Commissioners will be announced during this first public hearing.

The property, known as 9494 Summerfield, LLC, consists of ±39.27 acres of ±17.41 acres of Commercial (COM) and ±21.86 acres of Medium Residential (MR) FLUMS designation and a Planned Unit Development (PUD) zoning. The property is located on 9494 HWY 42 Summerfield, south of HWY 42 and approximately 0.5 miles west of HWY 441. A detailed legal description of the property is on file with the Marion County Growth Services Department, located at 2710 East Silver Springs Boulevard, Ocala, Florida 34470. All of the property is located within the jurisdictional boundaries of Marion County. Figure 1 shows the general location of the property.

The intended purpose of the Termination is to terminate the active developer’s agreement between Marion County and Lloyd (Loyd) J. Folks, dated August 24, 2001, and recorded on June 27, 2003, in O.R. Book 3450, Page 484, Public Record of Marion County, Florida, because in Rezoning case (221108ZP) a Planned Unit Development Conceptual Plan was approved by the Board of County Commissioners on November 15, 2022, with Resolution No. 22-R-579. Since the time the Developer’s Agreement was executed, Marion County has amended its Comprehensive Plan and Land Development Code such that the requirements in the Developer’s Agreement are now incorporated in the attached approved Planned Unit Development Conceptual Plan dated October 28, 2022. As a consequence, the Developer’s Agreement is no longer necessary.

The proposed development use of the property, as approved in the Planned Unit Development Rezoning, is for 196,750 square feet of self-storage (inclusive of the self-storage operation’s office space), 35,000 square feet of general retail, 8,000 square feet of office space, and a total of 78 single-family units and accompanying accessory amenities consistent with Marion County Land Development Code.

The PUD proposes a maximum of 239,750 square feet of commercial space on ±17.41 acres or a floor area ratio of 0.32. Residential use proposes a maximum of 78 single dwelling units on ±21.86-acre or a density of 3.57du/ac.

The commercial buildings shall be a maximum of 50’ in height and the single-family dwelling shall be a maximum of 40’ in height, consistent with the conceptual plan. A copy of the previous Developer’s Agreement related to this proposed Termination may be obtained at the Marion County Growth Services Department at 2710 East Silver Springs Boulevard, Ocala, Florida 34470; telephone (352) 438-2600; between the hours of 8:00 AM and 5:00 PM, Monday through Friday.
